Program Overview

You agree to receive recurring automated promotional and personalized marketing text messages (e.g., SMS and MMS) from Biorenewal, including messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number you designate.

Consent to receive automated marketing text messages is not a condition of any purchase. Msg & Data rates may apply. Message frequency will vary. Biorenewal reserves the right to alter the frequency of messages sent at any time and to change the shortcode or phone number from which messages are sent. We will notify you of any such changes.

Not all mobile devices or handsets may be supported, and messages may not be deliverable in all areas. Biorenewal, its service providers, and supported mobile carriers are not liable for delayed or undelivered messages.

Our platform may not recognize unsubscribe requests that do not include one of the above keywords. If you unsubscribe from one program, you may continue to receive messages from other Biorenewal programs until you separately unsubscribe from each.

Dispute Resolution

Any dispute arising out of or related to these Messaging Terms or your receipt of text messages from Biorenewal will be resolved by binding arbitration. Arbitration uses a neutral arbitrator instead of a judge or jury, and arbitrators can award the same damages and relief that a court can award. This agreement covers all claims arising out of these Messaging Terms or your receipt of text messages, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.

Exceptions: Nothing herein waives the right of either party to bring an individual action in small claims court; pursue enforcement action through applicable federal, state, or local agencies; seek injunctive relief in aid of arbitration; or file suit to address an intellectual property infringement claim.

Arbitrator: Arbitration will be governed by the Federal Arbitration Act and the Commercial Dispute Resolution Procedures of the American Arbitration Association (“AAA”), as modified by these Messaging Terms. AAA Rules and filing forms are available at www.adr.org or by calling 1-800-778-7879.

Notice & Process: The party seeking arbitration must first send written notice by U.S. Mail to: Biorenewal LLC, 125 NE 32nd St, Unit 1719, Miami, FL 33137, Attn: Chief Executive Officer. The notice must describe the nature of the dispute and the specific relief sought. Both parties will make good faith efforts to resolve the claim within 30 days of receiving such notice before commencing arbitration.

Fees: For claims of $15,000 or less, Biorenewal will reimburse your filing fee. You may choose arbitration by document submission, telephone hearing, or in-person hearing per AAA Rules. For claims over $15,000, fees are decided by AAA Rules. The arbitrator must issue a reasoned written decision, and all information exchanged during arbitration will be kept confidential except as necessary to enforce or permit limited judicial review of the award.

No Class Actions

The arbitrator may not consolidate more than one person’s claims, and may not preside over any form of representative or class proceeding, unless both parties agree otherwise in writing.

Modifications & Enforceability

If Biorenewal makes any future change to this arbitration provision (other than a change to our notice address), you may reject the change by sending written notice within 30 days of the change to our address above. The prior arbitration provision will then continue to govern any disputes between you and Biorenewal.

If any provision of these Messaging Terms is found to be unenforceable, that provision will be severed and the remainder of these Messaging Terms will remain in full force and effect.
